Showbiz Sandbox 252: Crouching Netflix, Hidden IMAX and the Myth of Broken Release Windows

The Weinstein Co. stunned the entertainment industry last week by announcing they would distribute the sequel to “Crouching Tiger, Hidden Dragon” simultaneously on Netflix and IMAX. As Brooks Barnes of the New York Times explains, the plan only has one problem; movie theaters refuse to show any film that opens day-and-date on home video or video-on-demand. This begs the question, if a movie never opens theatrically, was it’s release window really broken?

Netflix continued to make additional headlines later in the week by signing a deal with actor Adam Sandler to make four original movies for the streaming service. We discuss whether Netflix is changing the Hollywood paradigm or simply becoming one more buyer of premium content.

While Netflix is leaning into the future, director Christopher Nolan is taking a more old fashioned approach by releasing his upcoming movie on actual film. Select theaters showing “Interstellar” on analogue celluloid will get the film two days early. But will theater owners, who recently converted to digital cinema, still know how to thread a 35mm projector?

Showbiz Sandbox 251: In the Digital Age, Content Rights Are King

Whether an illustrator creating legendary comic book characters for Marvel or a 1960’s pop group that hasn’t had a hit in decades, owning the rights to the content one produces has never been more important thanks to emerging digital distribution platforms. Unfortunately, determining who owns the rights for specific content is becoming increasingly more difficult.

For example, last week’s landmark court ruling against satellite radio provider Sirius XM could mean the company has to start paying public performance royalties on pre-1972 sound recordings. The case has huge copyright implications not just for Sirius XM, but also to streaming radio services like Pandora.

Access to content is likely the reason Softbank is making a play to acquire DreamWorks Animation. Should a deal be struck then only time will tell whether there is actually any synergy between the animation studio and the Japanese conglomerate.

Showbiz Sandbox 250: TV Ratings Have Become Messy, Misleading and Downright Maddening

Picking the winners and losers out of this year’s new television shows has never been more difficult. Just ask Marc Berman, editor-in-chief of TV Media Insights, joins us to explain how DVR’s and on-demand viewing have made overnight TV ratings very problematic. Berman says that these days the number of viewers watching a show when it airs is less important than its total audience during the week that follows.

Those looking for entertainment on a screen larger than the average television can head to movie theaters where they can watch the recently released “Maze Runner” in the new Barco Escape format. The experimental offering wraps three screens around the audience to provide a 270 degree viewing experience.

At the other end of the spectrum there are screens of a less significant size, like those found on the ever increasing number of e-readers. Amazon continues to improve its Kindle line and new the latest gadgets from Apple have excited publishing industry observers. We’ll explain why.

Showbiz Sandbox 249: Why Film Festivals Are More Important Than Ever

Anne Thompson, an editor at Thompson on Hollywood and Indiewire, just spent the past two weeks at the Telluride and Toronto Film Festivals before she heads off to the New York Film Festival. Thompson takes us through some of the noteworthy films we’ll be seeing in coming months and discuss the important role festivals play in creating buzz before a movie’s commercial release.

The competition for landing premieres of noteworthy titles has become so fierce that Toronto switched up its programming this year to give less prominence to any film screening a week earlier at Telluride. One aspect of each festival which is unlikely to change is their reputation for selecting films that go on to win Best Picture Oscars.

While fall festivals might be the talk of the film industry, television executives have been preoccupied with their over-the-top strategies. As audiences switch to OTT offerings from Amazon to Roku, networks are experimenting with direct-to-consumer offerings while contending with increasingly meaningless overnight ratings.

Showbiz Sandbox 248: Hollywood Squeezes States For More Tax Breaks

California is set to triple their tax subsidies for film and television production to more than $330 million annually in an effort to stem the tide of runaway production to states with larger tax incentives. Richard Verrier of the Los Angeles Times discusses the growing debate over the value of film tax breaks and whether they actually create new jobs, or just shift them to different locations.

There is absolutely no debate over whether this summer’s box office was down from the previous year. However as we explain, comparing year-over-year box office figures is misleading at best and ultimately a fool’s errand.

In an unusual move the rock band U2 will be giving away its new album “Songs of Innocence” to more than 500 million iTunes users for a limited time. Making the release free to download only serves to further underscore where most artists make their money these days; on tour.

Showbiz Sandbox 247: Everything You’ve Heard About This Summer’s Box Office Is Wrong

Listening to the chorus of industry naysayers or reading all the media reports might lead you to believe this year’s summer movie season was a complete financial disaster from which Hollywood could not recover. Granted, North American box office declined 15% from the same period last year, marking an 8 year low, and attendance was off by 5%. Even so, there were no huge flops over the summer and certainly none that would send a shiver down the spine of studio execs.

In fact, most of this summer’s releases will make money when international receipts are added to their theatrical grosses. The only problem with that, as Ben Fritz of the Wall Street Journal points out, is that not all box office dollars are counted equally when they are earned overseas.

We’ll also discuss how giant telecom companies are trying to maintain their stranglehold on the Internet in the United States by preventing cities from offering broadband to residents as a public utility. Such legal skirmishes are becoming more important as we move toward streaming services for movies and music.

Showbiz Sandbox 246: The Emmys Have A Hopeless Scheduling Problem

It’s bad enough that the Emmy Awards honor the exact same talent and television shows every year. Now, the Emmys are really growing stale by handing out prizes to shows that finished airing before last year’s ceremony. Unfortunately, as television migrates to year round programming, there is no good time to schedule the Emmys which would make them feel more timely or relevant.

The industry-at-large was likely glad to see at least one aspect of the Emmys go unchanged as shows from broadcast and cable networks continue to win the most awards over shows from streaming services such as Netflix, which went home empty handed. There also, thankfully, seems to be a voter backlash against shows positioning themselves in odd categories.

Meanwhile, August has proven to be the cruelest month for show business with the untimely death of actor Robin Williams and the passing of Hollywood legend Lauren Bacall, among others.

Showbiz Sandbox 245: Guardians of the Celluloid – Hollywood Big Shots Rally Around Film Stock

With the entertainment industry having fully embraced digital technology, the world’s only remaining motion picture film supplier was preparing to cease manufacturing 35mm stock. However, a group of influential filmmakers, Christopher Nolan and Quentin Tarantino among them, have convinced studios to enter into an agreement with Kodak that will keep celluloid alive for a few more years.

Digital technology was actually supposed to simplify the production and distribution of movies, music and television. Yet as the industry adapts to new tools and workflows the learning curve has been long and steep. The most recent example occurred when a digital content file was mislabeled and caused cinemas to play the wrong movie.

Meanwhile, the television streaming service Aereo can’t seem to catch a break. Even after tge U.S. Supreme Court ruled they are acting as a cable operator the U.S. Copyright Office refuses to issue Aereo a compulsory license claiming they are not a cable company.

Showbiz Sandbox 244: Hollywood Faces An Epic Struggle Over the Future of Entertainment Distribution

Whether it’s movies streaming online before they premiere in theaters, the never-ending retransmission dispute between television networks and cable companies or the dwindling number of book retailers, how media companies are distributing their content has never been more in flux.

The Weinstein Company released their critically acclaimed release “Snowpiercer” on VOD just two weeks after the film opened in cinemas. Then they agreed to let “One Chance”, a biopic of talent show winner Paul Potts, stream free on Yahoo! ten days before the movie opens in the United States.

Meanwhile, rather than sell you books, Amazon is hoping you’ll be willing to pay a monthly fee for their new e-book subscription service. The only problem is the service’s limited selection (not to mention the company’s inability to make a profit), making us wonder whether such a business model is viable.

Showbiz Sandbox 243: United They Stand – SAG-AFTRA Forges Ground-Breaking Contract

Two years after merging their unions, and with their current contracts set to expire within hours, SAG-AFTRA reached an agreement with studios and producers for a new three-year contract. Jonathan Handel, an entertainment attorney and contributing editor at the Hollywood Reporter, discusses the proposed deal and what improvements actors managed to secure.

Music sales, on the other hand, aren’t improving at all. Nielsen reports that album and digital download sales for the first half of 2014 are down significantly. Could the increase in on demand music streaming be the cause?

Movies aren’t faring much better so far this year, at least not in North America and Germany where box office is down 12% and 8% respectively. Is something amiss with this summer’s blockbuster releases, or is setting new earnings records every year simply unrealistic?
