Showbiz Sandbox 480: “Parasite” Infects the Oscars With Historic Win

Though many Academy Awards pundits believed that “1917” would win the Oscar for Best Picture, the prize went to filmmaker Bong Joon-ho’s “Parasite.” Anne Thompson of Indiewire joins us to explain how the industry united behind the South Korean film, giving it four top Oscars, in a historic win; the first foreign language film to ever win the Best Picture Oscar.

Surely none of the Oscar winners will be getting a bump at the box office in China, even if they managed to get a release date. Movie theaters have been closed for the past three weeks due to a coronavirus which has completely upended which films will get into cinemas and when in a tight calendar they’ll reach audiences.

Meanwhile, the WGA overwhelmingly approved their demands for the upcoming contract talks with producers and studios. The existing contract is set to expire in the middle of this year and just about everyone in Hollywood is expecting and gearing up for another writers’ strike.

Showbiz Sandbox 479: Are Streamers Ruining Sundance?

About every five years a new group of deep-pocketed players shows up at the Sundance Film Festival and spends a small fortune acquiring a handful of films causing fear that the industry has been forever changed. This year, some of the world’s largest media and tech companies have invaded Park City, Utah and are picking up movies for amounts far in excess of what makes fiscal sense or what theatrical distributors are willing to pay.

Such companies don’t have to worry about box office results because they are more concerned with a different metric; the number of subscribers they can attract to their streaming service. Now some industry veterans are worried about whether indie distributors will be able to stay afloat with the leftover titles the streaming giants don’t gobble up.

Meanwhile, in China the film industry is down for the count with cinemas shuttered for the second week in a row due to the rapid spread of a coronavirus. Flights to and from the country have been suspended, as has all film and television production. When movie theaters finally do open for business the ripple effect on the Chinese release schedule will be felt around the world as films jockey for new playdates.

Showbiz Sandbox 470: The End of the Paramount Consent Decree

The Department of Justice has announced their intention to jettison the Paramount Consent Decree, the agreement that ended the studio system and under which the film industry has operated for the past 70 years. What will this mean for movie theater operators moving forward? Now that studios have become big media conglomerates will they behave anti-competitively?

Speaking of agreements, more mid-level talent agencies have signed the Writers Guild of America’s code of conduct. In the process, these agencies have gotten the WGA to agree not to enforce the ban on television packaging until one of four major firms signs on.

Meanwhile, the Thanksgiving holiday weekend was once again a time for audiences to return to cinemas en masse. However this year instead of going to see the latest blockbuster sequel, moviegoers actually sought out original films.

Showbiz Sandbox 469: Hollywood Unions Set For Fight Over Streaming Residual Payments

As television networks turn from linear broadcast methods to consumer streaming platforms a brewing battle over residual payments has the potential to spark a dual union strike in the middle of next year. Jonathan Handel, an entertainment attorney and a contributing editor at The Hollywood Reporter, joins us to discuss how the lack of data coming from streaming giants could lead to a standoff between major guilds and producers.

Indeed, in mid-2020 the master contacts between the Alliance of Motion Picture and Television Producers and the Directors Guild of America, The Writers Guild of America and SAG-AFTRA are set to expire. By now negotiations on new contracts would be well underway. Instead talks have stalled as unions try to revise the formulas used by streamers to make residual payments to their members. Given the timing, it’s a perfect storm for a potential massive industry work-stoppage.

Meanwhile, the Broadway musical “Tootsie” is closing long before it recoups its production costs. Michael Riedel of the New York Post has a host of reasons for why this critic’s darling didn’t click, however only one of them makes sense; the show’s music wasn’t all that great.

Showbiz Sandbox 466: How Hollywood Kowtows to China

Entertainment companies are finding themselves in compromising positions when it comes to avoiding political pitfalls in China. Movie studios and media conglomerates don’t want to disrupt their bottom line by appeasing Chinese authorities while surrendering their creative freedom. The result is that companies distributing content in China find themselves censoring themselves.

“South Park,” on the other hand, chose an alternative path; directly offending the Chinese government and immediately being banned throughout the country. Even when companies do kowtow to the Chinese government, they find themselves getting into trouble at home and abroad. Just ask the producers of the animated film “Abominable,” an animated film which was banned in the country for showing a map that favored China’s disputed territorial claims.

Meanwhile, the new television season started. Not that you’d know it based on the ratings, which are down almost any way you slice them. And the clear message is this: people’s viewing habits have changed, probably forever, and it’s not going to help TV channels trying to sell eyeballs to advertisers.

Showbiz Sandbox 460: Spider-Man Exits The Marvel Cinematic Universe

The big-time Hollywood divorce that has the entertainment industry buzzing this summer is the acrimonious split between Sony Pictures and Walt Disney Studios over custody of the most popular character in the Marvel Cinematic Universe; Spider-Man. The agreement that allowed Sony to loan out the character for Disney’s Avenger films was unprecedented. But after Disney asked to share in the financing and profit of future Spidey films, Sony opted out of the relationship.

The latest Spider-Man movie was one of the biggest hits of the summer, though box office for the season was actually down. One might think that’s why AMC Cinemas is planning to experiment with dynamically pricing movie tickets, but actually it’s really because they just want to charge more for popular films.

Meanwhile, streaming giants like Netflix are premiering some of their high profile movies at the biggest fall film festivals just in time to kick off awards season. They even plan to show them in cinemas before allowing them to be streamed on their platform. Now all Netflix has to do is convince cinema chains to book them.

Showbiz Sandbox 458: The Number of Music Copyright Lawsuits Is Sure To Increase

Are musicians ripping each other off more than ever? Accusations of plagiarism have been around a long time, but they exploded after musician Robin Thicke was successfully sued over lifting his song “Blurred Lines” from Marvin Gaye’s “Got To Give It Up.” Just ask Katy Perry who recently lost a similar lawsuit over her hit single “Dark Horse.”

Before that case, most legal experts said you needed specific lyrics or main melodies to constitute stealing. Now the courts have decided that beats and even the vague “feel” or “vibe” of a song can be copyrightable.

Meanwhile, Netflix lost subscribers for the first time since 2011 and you’d think the sky was falling. What with new competition from Disney, Warner Bros. and Apple about to launch, there are plenty of doomsayers prognosticating the demise of the streaming giant.

Showbiz Sandbox 457: The Biggest Touring Musical Acts Are Older Than Ever Before

Take a quick look at the top earning worldwide concert tours and you might be surprised to discover that half of the top ten acts are over 50-years-old. Heck, the number one tour of the year thus far is Elton John and he’s over 70. In fact, thanks to acts like Fleetwood Mac and Bob Seger, the average age of the top ten global touring acts has surpassed 50 for the first time anyone can remember.

Inversely, the age of the top ten recording artists of the year is getting younger, dropping below 30-years-old. This is due in large part to artists such as Ariana Grande, Post Malone, Travis Scott and Khalid who are all under 30 and in the case of Billie Eilish, under 20. We try to understand the age disparity between today’s biggest recording artists and those making their money on the road.

Meanwhile, in China, the burgeoning movie business has fallen on hard times. This is especially true in the cinema industry, where theater owners are contending with a drop in audiences flocking to the glut of new multiplexes that have opened in recent years. At the same time rents for theater locations have skyrocketed and the government imposed quota of foreign releases means many exhibitors are running out of content to show.

Showbiz Sandbox 453: The Biggest Disaster in the History of the Music Industry

When a fire ripped through Universal Studios in Los Angeles back in 2008 it was initially feared that all of the historic films and music locked away in the vaults that burned were lost forever. At the time Universal reported that, quite miraculously, very little damage had occurred and that few, if any, of the master recordings in the vaults were damaged.

However, in an in-depth investigative piece The New York Times reports that the fire actually wiped out hundreds of thousands of invaluable masters of legendary recording artists such as Louis Armstrong, Chuck Berry, Duke Ellington, Billie Holiday, Elton John, Nirvana and possibly hundreds of others. Universal Music Group continues to insist the loss is overstated, but artists are clamoring for more information and the first class action lawsuit has already been filed.

Meanwhile talks between the Writers Guild of America and the Association of Talent Agents over packaging fees and affiliate productions have stalled and now lawsuits have started to fly.

Showbiz Sandbox 452: The Tony Awards Go To Hell

The 2018-19 Broadway season was a banner year as the Great White Way broke box office and attendance records, earning $1.89 billion from an attendance of 14.8 million patrons. The Tony Awards were handed out to the season’s best productions and performances as “Hadestown,” a musical about Hell, took home eight prizes including Best Musical and “The Ferryman” won four trophies including Best Play.

During this episode we take a different approach to reporting box office; rather than report which movie topped the worldwide charts, we look which title earned the most money over the past week. Why only count Friday through Sunday, when there are four may days to every week in which people are seeing movies.

We are also joined by Patrick von Sychowski, the editor of Celluloid Junkie, who tells us how he put together an exclusive story of how Chinese authorities spent three years tracking and shutting down one of the largest movie piracy rings of all time. After uncovering piracy being done on an industrial scale, the question remains, could it happen again.
